Terms and Conditions of Service

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use the Service.

1. Acceptance of Terms

By downloading, installing, or using Kookboard, you affirm that you are at least 14 years of age (or the minimum legal age in your country to consent to data processing) and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.

2. Description of Service

Kookboard is a digital platform designed to allow users to discover, create, organize, and share cooking recipes, culinary ideas, and related content. The service may include social features, search tools, interactive components, and advertisements. OpusFactory reserves the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

3. User Accounts and Security

To access certain features of Kookboard, you may be required to register for an account.

• You can register using an email address and password, or through third-party authentication providers (such as Google or Meta/Facebook).
• If you link multiple authentication methods using the same email address, our system (powered securely via Supabase) may automatically merge these identities into a single user profile.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User-Generated Content (UGC)

Users may post, upload, publish, or share content, including but not limited to recipes, text, ingredients, instructions, reviews, comments, and photographs ("User Content").

Ownership: You retain all of your ownership rights in your User Content.

License Grant: By posting User Content on Kookboard, you grant OpusFactory a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and OpusFactory's business operations.

Responsibility: You are solely responsible for your own User Content. You represent and warrant that you own or have the necessary licenses, rights, and permissions to publish the content you submit and that it does not infringe upon any third-party intellectual property or privacy rights.

Prohibited Content: You agree not to post any content that is unlawful, offensive, defamatory, obscene, commercial advertising (not authorized by us), or that contains malicious code or software viruses. We reserve the right to remove any User Content at our sole discretion without notice.

5. Intellectual Property Rights

Excluding User-Generated Content, all contents of the App, including but not limited to the source code, user interface design, graphics, logos, branding, trademarks, and proprietary software features, are the exclusive property of OpusFactory and are protected by international copyright, trademark, and intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our express written consent.

6. Advertisements and Third-Party Links

Kookboard displays advertisements and promotional content, which may be personalized or contextual, powered by third-party ad networks (such as Google AdMob).

The App may also contain links to third-party websites, services, or products that are not owned or controlled by OpusFactory.

OpusFactory does not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. Your interactions with advertisers or third-party links found on the App are solely between you and such third parties.

7. Privacy and Data Protection

Your privacy is important to us. The collection, use, and processing of your personal data (such as email addresses, profile data, and usage analytics) are governed by our Privacy Policy, which is compliant with applicable data protection laws, including the General Data Protection Regulation (GDPR). By using Kookboard, you consent to the data practices described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law, OpusFactory and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App;
• Any errors, inaccuracies, or safety hazards in the recipes, instructions, or ingredients shared on the platform (users cook at their own risk);
• Any unauthorized access to or use of our servers and/or personal information stored therein;
• Any conduct or content of any third party on the App.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Italy, and you hereby consent to the personal jurisdiction and venue therein.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this document or via in-app notifications. Your continued use of the App following the posting of any changes constitutes acceptance of those changes.
