Terms and Conditions of Service

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use the Service.

1. Acceptance of Terms

By downloading, installing, or using Kookboard, you affirm that you are at least 14 years of age (or the minimum legal age in your country to consent to data processing) and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.

2. Description of Service

Kookboard is a digital platform designed to allow users to discover, create, organize, and share cooking recipes, culinary ideas, and related content. The service incorporates cloud database synchronization and advanced cloud-based artificial intelligence utilities. OpusFactory reserves the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

3. User Accounts and Security

To access certain features of Kookboard, you may be required to register for an account.

• You can register using an email address and password, or through third-party authentication providers (such as Google or Meta/Facebook).
• If you link multiple authentication methods using the same email address, our system (powered securely via Supabase) may automatically merge these identities into a single user profile.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Artificial Intelligence Tools and Service Limits

The App integrates artificial intelligence features powered by third-party large language models, specifically Google Gemini, to parse external links, documents, images, and raw text into structured recipe formats.

• Usage Quotas: To maintain operational sustainability, authenticated users are granted a complimentary allocation of 8 AI processing transactions per calendar month. This balance is tracked on our servers and automatically resets on the 1st day of each month.
• AI Content Disclaimer: Artificial intelligence models can generate inaccurate data, anomalies, or hallucinated instructions. All text, cooking durations, ingredients, or methods generated or enhanced by the AI are provided purely for convenience. You assume full risk and responsibility for validating the safety, accuracy, and edibility of any recipe generated through these tools.

5. User-Generated Content and Prohibited Conduct

Users may post, upload, publish, or share content, including but not limited to recipes, text, ingredients, instructions, reviews, comments, and photographs ("User Content").

Ownership: You retain all of your ownership rights in your User Content.

License Grant: By posting User Content on Kookboard, you grant OpusFactory a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and OpusFactory's business operations.

Prohibited Content: You strictly agree not to submit, paste, or link any content that is unlawful, offensive, defamatory, obscene, pornographic, commercial advertising (not authorized by us), or that constitutes malicious spam or structural platform exploitation.

6. Automated Moderation, Warnings, and Account Enforcement

To maintain service integrity and comply with mobile app store guidelines, OpusFactory employs automated moderation filters (including AI-powered analysis) to evaluate all user-submitted content at the time of creation or modification.

If our moderation workflow triggers a positive match for prohibited content (such as explicit NSFW material, spam scripts, or non-culinary advertisements), the following automated enforcement mechanisms apply:

• The Strike Mechanism: A formal infraction record ("strike") is appended to your account profile. Minor infractions follow a 30-day good behavior window; if no further violations occur within 30 days of the last logged incident, the strike count is eligible for automated reset.
• Progressive Account Suspensions: Accumulating three (3) active strikes will cause our servers to immediately revoke your access to the App's core cloud ecosystem via a phased suspension protocol:
  — First Account Lockout: 7-day temporary suspension.
  — Second Account Lockout: 30-day temporary suspension.
  — Third Account Lockout: Permanent termination of account access.

OpusFactory maintains final administrative authority regarding what constitutes abusive content or platform exploitation, and reserves the right to issue overrides or apply instant bans for extreme violations without notice.

7. Intellectual Property Rights

Excluding User-Generated Content, all contents of the App, including but not limited to the source code, user interface design, graphics, logos, branding, trademarks, and proprietary software features, are the exclusive property of OpusFactory and are protected by international copyright, trademark, and intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our express written consent.

8. Advertisements and Third-Party Links

Kookboard may display advertisements, sponsored placements, or promotional content, which may be personalized or contextual, powered by third-party ad networks (such as Google AdMob).

The App may also contain links to third-party websites, services, or products that are not owned or controlled by OpusFactory.

OpusFactory does not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. Your interactions with advertisers or third-party links found on the App are solely between you and such third parties.

9. Privacy and Data Protection

Your privacy is important to us. The collection, use, and processing of your personal data, consumption logs, and account metrics are governed by our Privacy Policy, which is compliant with applicable data protection laws, including the General Data Protection Regulation (GDPR). By using Kookboard, you consent to the data practices described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, OpusFactory and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App;
• Any errors, algorithmic inaccuracies, omissions, or safety hazards found within the recipes, nutritional estimations, instructions, or ingredients processed by our AI utilities or shared on the platform (users prepare food at their own risk);
• Any unauthorized access to or use of our servers and/or personal information stored therein;
• Any conduct or content of any third party on the App.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Italy, and you hereby consent to the personal jurisdiction and venue therein.
